3.1. Collaborators

Partners are aware that: (i) the Service is not an archival or file storage service, and we are not obliged to preserve or backup the Data uploaded, imported, or posted by the Partner, or generated during their use of the Service; (ii) it is the Partner's responsibility to back up the Data; and (iii) any Data that has been deleted at our discretion or as mandated by law and/or legal authority will result in loss of access.

Partners recognize and acknowledge that the Internet and its communications may lack security, providing opportunities for unauthorized access to computer systems, networks, and stored data. Information transmitted through the Internet or stored on any connected equipment may not remain confidential, and we do not guarantee privacy, security, authenticity, non-corruption, or non-destruction of such information. We rely on Partner consent or representations that the necessary consent from their users, visitors, and/or customers has been obtained to process Personal Data. Additionally, Personal Data processing may occur to fulfill contractual obligations with Partners or as required by law.

Furthermore, Personal Data may be processed based on our or our Partners' legitimate interests, provided these interests do not override the individual’s data protection rights as determined by applicable jurisdiction.

Partners acknowledge that the Data provided to us may include personally identifying information or personal data, as defined by relevant laws governing data usage. By granting us a non-exclusive right and license to process the Data, Partners authorize us to use, reproduce, display, transmit, and store the Data for Service provision. We may redact, anonymize, and/or aggregate the Data to enhance product and service development and quality improvement initiatives. We may function as either a Processor or Controller, as defined in data protection regulations:

  • For data provided directly by Visitors and/or Users, we assume the role of Controller.
  • For data provided by Partners, including their users', visitors', and/or customers' data, we act as Processor.
  • All data collected is securely stored, with hosting performed in compliance with strict security standards.
  • We employ physical, technical, and organizational safeguards against unauthorized access, alteration, or processing of Partner and Personal Data.
  • Prompt notification will be provided to Partners in case of known unauthorized data access.

When Partners process Personal Data as part of third-party platform usage, they must adhere to GDPR and/or Data Protection Laws and Regulations. Partners are obligated to:

  • Comply with processing instructions from the third-party platform.
  • Ensure appropriate measures are taken to prevent unauthorized processing.
  • Inform us and the third-party platform of any data breaches.
  • Obtain consent for data processing outside the European Economic Area.
  • Respect recipients' preferences regarding electronic marketing communications.
